1. Acceptance of Terms

Welcome to Hey Neighbour. These Terms of Service ("Terms") govern your access to and use of the Hey Neighbour mobile application (the "App"), operated by Titanium Cranium ("we," "our," or "us").

By downloading, accessing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App.

2. Description of Service

Hey Neighbour is a location-based mobile application that enables users to:

• Connect with neighbours and community members in their local area
• Post and respond to help requests
• Discover nearby users based on proximity
• Share information and communicate with community members
• Build trusted local community relationships

The App requires location services to function properly. We reserve the right to modify, suspend, or discontinue any aspect of the service at any time.

3. Eligibility

You must be at least 13 years old to use Hey Neighbour. By using the App, you represent and warrant that:

• You are at least 13 years of age
• You have the legal capacity to enter into these Terms
• You are not prohibited from using the App under applicable laws
• Your use of the App complies with all applicable laws and regulations

4. Account Registration and Security

4.1 Account Creation

To use Hey Neighbour, you must create an account using either Apple Sign-In or Google Sign-In. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your account credentials
• Be responsible for all activities under your account
• Notify us immediately of any unauthorised access or security breach

4.2 Account Termination

You may delete your account at any time through the App's Profile screen. We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our discretion.

5. User Conduct and Responsibilities

5.1 Acceptable Use

You agree to use Hey Neighbour only for lawful purposes. You will not:

• Post false, misleading, or fraudulent content
• Harass, threaten, intimidate, or harm other users
• Post offensive, abusive, or inappropriate content
• Violate any local, state, national, or international law
• Infringe on intellectual property rights of others
• Transmit spam, advertising, or promotional materials without consent
• Impersonate another person or entity
• Collect or harvest personal information from other users
• Use the App for commercial purposes without authorisation
• Attempt to gain unauthorised access to the App or its systems
• Interfere with or disrupt the App's operation
• Use automated systems (bots, scrapers) to access the App

5.2 Content Standards

All content you post must:

• Be accurate and not misleading
• Be respectful and appropriate for a community audience
• Comply with applicable laws and regulations
• Not contain violence, hate speech, or discriminatory content
• Not contain sexually explicit or suggestive material
• Not promote illegal activities or dangerous behavior

5.3 Safety

Hey Neighbour facilitates community connections, but we cannot guarantee the safety of interactions. You are responsible for your own safety. We recommend:

• Exercise caution when meeting people from the App in person
• Meet in public places for first meetings
• Trust your instincts and report suspicious behavior
• Do not share sensitive personal information (financial details, home address, etc.)
• Verify the identity and intentions of other users before engaging

6. User Content

6.1 Your Content

You retain ownership of content you post to Hey Neighbour, including help requests, responses, messages, and photos ("User Content"). By posting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your User Content solely to provide and improve the App.

6.2 Content Moderation

We reserve the right, but have no obligation, to:

• Monitor, review, or remove User Content
• Remove content that violates these Terms
• Take action against users who violate these Terms

6.3 Reporting

If you encounter content or behavior that violates these Terms, please report it to us at hello@hey-neighbour.com.au

7. Location Services

Hey Neighbour requires access to your device's location services to function properly. By using the App, you consent to the collection and use of your location data as described in our Privacy Policy.

You can control location permissions through your device settings, but disabling location access will significantly limit the App's functionality.

8. Intellectual Property

The App, including its design, features, code, graphics, and content (excluding User Content), is owned by Titanium Cranium and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the App without our express written permission. You may not reverse engineer or attempt to extract source code from the App.

9. Third-Party Services

The App uses third-party services including:

• Firebase (Google) for backend services
• Apple Sign-In for authentication
• Google Sign-In for authentication

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices or content of third-party services.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties regarding accuracy, reliability, or availability of the App
• Warranties that the App will be uninterrupted, secure, or error-free
• Warranties regarding the quality of the service or content

We do not guarantee the accuracy, completeness, or reliability of User Content or any information obtained through the App. You use the App at your own risk.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TITANIUM CRANIUM SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from your use or inability to use the App
• Damages resulting from interactions with other users
• Unauthorised access to or alteration of your content or data
• Content or conduct of any third party on the App

Our total liability for any claims arising from these Terms or the App shall not exceed the amount you paid to use the App in the past 12 months, or $100, whichever is greater.

12. Indemnification

You agree to indemnify, defend, and hold harmless Titanium Cranium, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your User Content
• Your violation of any rights of another party

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App and updating the "Last Updated" date. Your continued use of the App after changes constitutes acceptance of the updated Terms.

14. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including:

• Violation of these Terms
• At your request (account deletion)
• Discontinuation of the App
• For any other reason at our discretion

Upon termination, your right to use the App will immediately cease. Sections of these Terms that by their nature should survive termination will survive.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration or in the courts of Australia, and you consent to the personal jurisdiction of such courts.

16. Miscellaneous

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Titanium Cranium regarding the App.

16.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.

16.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.
